General Terms and Conditions of Dennier Eigenverlag

1. Scope

For the business relations between the publisher and the customer, the following general terms and conditions in their version valid at the time of the order apply exclusively, even for all future transactions. The publisher does not accept any deviating terms and conditions of the customer, unless the publisher has expressly agreed to their validity in writing. In addition, the commercial practices laid down in the traffic regulations of the German book trade are to apply within their legal framework.

Amendments or additions to these General Terms and Conditions must be made in writing.

2. Conclusion of the contract

The contract for a binding order for the goods contained in the shopping cart is concluded after entering the personal data by clicking on the order button in the final step of the ordering process. Confirmation of receipt of the order takes place immediately after the order has been sent. The purchase contract is legally binding upon receipt of our order confirmation or delivery of the goods.

The publisher makes every effort to avoid errors in its offers. Prices are subject to change.

3. Delivery and shipping

Digital download materials are ESD (Electronic Software Delivery), so there is no cost of delivery and shipping.

4. Price, Due Date, Payment and Download

The prices and conditions valid on the day of invoicing will be charged.

Unless otherwise agreed in writing, the purchase price becomes due immediately. The customer can pay the purchase price by credit card, PayPal  or advance bank transfer. Bank fees and bank charges shall be borne by the customer.

When ordering worksheets or eBooks as digital download materials, the customer agrees to the "dispatch" of the goods by download. The customer will be forwarded directly to the download after the invoice has been paid. In addition, the customer receives a link to download via e-mail. Here the customer can download his order a maximum of two times.

The customer is only entitled to set-off if his counterclaims have been legally established or recognised by the publisher. The customer is only entitled to exercise a right of retention if his counterclaim is based on the same contractual relationship.

5. License models

We distinguish between two types of license models

Our digital download materials (eBooks and worksheets) are partially password protected.

To use our single licenses, a license number (password) is required, which is purchased with the purchase and download of the file. You will receive the license number by email with the download link.

to use our school licenses no license number is required.

5.1. Purchase of digital download materials as a single license

With the purchase of single license, licensee acquires a usage license that refers to the name and address indicated on the invoice. The use is permitted privately or as part of your own lesson preparation. Printed work materials may be issued to their own learners. A single license does not allow the distribution of digital download materials to teachers and learners and distribution on in-school networks. It is also not permitted to be distributed on the Internet.

5.2. Purchase of digital download materials as a school license

With the purchase of a school license, the license refers to all employed teachers of the school/educational institution, which is indicated in the invoice with name and address. A school license does allow the distribution of digital download materials to teachers and learners and distribution on in-school networks. It is not permitted to be distributed on the Internet.

Restrictions

Neither the license, digital materials or parts thereof may be passed on, sold, published, rented, lent (including libraries) or used for Internet sites without the express written permission of licensor.

6. Copyright

When duplicating digital download materials of Dennier Eigenverlag for private and other own use, the provisions in accordance with Section 53 of the German UrhG (Copyright Act) apply.

When using print versions and/or digital download able to use the Dennier Eigenverlag material for the field of school and teaching, the provisions in accordance with Section 60a German UrhG (Copyright Act) apply.

When using materials of the Dennier Eigenverlag, copyrights of third parties must be observed.

7. Right of withdrawal

Our worksheets and eBooks are 'digital content' under Article 2(11) of the EU Consumer Directive, since the data is made available in digital form. Pursuant to Article 16 of the EU Consumer Directive, the right of withdrawal for digital content is excluded if:

  • you have started running the download,
  • you have expressly consented to this download and
  • have taken note of the fact that you will lose your right of withdrawal as a result.

8. Other

    The place of performance for all liabilities arising from the business relationship with the customer is Detmold (Germany), the place of jurisdiction for merchants is Detmold (Germany).

    Should any part of the contract or these General Terms and Conditions be ineffective, this shall not affect the validity of the contract or these conditions in the remainder.
